Think Swift Pty Ltd (ABN 90 685 252 902) (“ThinkSwift”, “we”, “us”, “our”) is a Melbourne-based custom software agency. These Terms of Use apply to your use of our website, thinkswift.com.au (the “site”). By using the site, you agree to these terms. If you don’t agree with them, please don’t use the site.

2. Our services

The site describes the services we offer and shares our thinking through articles and case studies. Any services we actually provide to a client are governed by a separate written agreement, such as a proposal or statement of work. Nothing on this site forms part of any contract with us unless that agreement expressly says so.

4. Penny, our AI assistant

The site includes Penny, our AI digital receptionist. Penny is there to answer questions and help direct your enquiry. Her responses are generated by AI and are general information only — please don’t rely on them as professional advice, and check anything important with us directly. Conversations with Penny may be recorded and processed, including by third-party AI providers, as described in our Privacy Policy. Please avoid sharing sensitive personal information in chat.

5. Information, not advice

Content on the site — including our blog, guides, and case studies — is general information. It isn’t business, legal, financial, or technical advice tailored to your circumstances, and the technology landscape we write about changes quickly. We work to keep our content accurate and current, but we don’t guarantee it, so please make your own enquiries before acting on anything you read here.

6. Intellectual property

All content on the site — including text, design, graphics, logos, and case studies — is owned by ThinkSwift or its licensors unless otherwise stated. You’re welcome to view and share it for personal, non-commercial purposes. You may not copy, reproduce, distribute, or commercially exploit any of it without our prior written consent. Client names and logos shown on the site belong to their respective owners.

7. Third-party links

The site links to external websites for your convenience. We don’t control those sites and aren’t responsible for their content or privacy practices.

8. Privacy

Our Privacy Policy explains how we collect and handle personal information, including information gathered through our forms, analytics, and Penny.

9. Availability

The site is provided “as is”. We don’t guarantee it will always be available, uninterrupted, or error-free, and we may change, suspend, or remove any part of it at any time without notice.

10. Liability

To the maximum extent permitted by law, we exclude liability for any loss or damage — including indirect or consequential loss, loss of data, or loss of business — arising from your use of, or inability to use, the site.

Nothing in these terms excludes, restricts, or modifies any consumer guarantees or other rights you have under the Australian Consumer Law or any other law that cannot be excluded. Where our liability can’t be excluded but can be limited, it’s limited to resupplying the relevant services or paying the cost of having them resupplied.
